摘  要：本文回顾了建国以来城市房屋拆迁法律法规制度的演变，折射出拆迁制度对被拆迁人的重大影响；运用法理分析的方法，分析《新拆迁条例》的不足之处，且为何难产。提出将土地使用权纳入拆迁补偿范围的法律正当性，纠正行政部门在拆迁法理关系中的角色定位，依法行政，更有利地依法保护被拆迁人的利益，营造“依法拆迁，阳光拆迁”的和谐氛围。
