摘要
随着经济社会的不断发展，大众的物质生活水平也在不断提高，居民的私家车的数量呈现出日趋增长的态势，因此这就需要在住宅小区之中开拓更广阔的多的空间，来使业主的停车需求得到满足，让其可以有位可停。但是在当前关于小区车位权属问题探讨的法律规定方面，提出的要求并不明确，还有空白点的存在，导致了有法难依的现象。
笔者在查阅大量文献资料的基础上，对“小区停车位权属”这一概念进行了分析与归纳，并且在借鉴予效仿国外完备俄日且先进的的停车位权属问题的法律法规同时，挖掘并且剖析现阶段我国停车位法律规定中存在的一系列具体问题，并且提出相关的可行性指导建议，进一步丰富和发展已有研究的内容。

Abstract
With the continuous development of economy and society, people's living standards continue to improve, the number of private cars is growing, which requires more space in the residential area to meet the parking needs of the owners. However, in terms of the current legal provisions on the discussion of the ownership of parking spaces in residential areas, the requirements put forward are not clear, and there are still blank points, resulting in the phenomenon of legal difficulties.
By consulting a large number of literature, the author analyzes and sums up the concept of "parking lot ownership in community", and at the same time, drawing lessons from the complete laws and regulations of parking lot ownership in foreign countries, at the same time, mining the specific problems existing in the current parking lot laws and regulations in China, and puts forward relevant guidance suggestions, enriching and developing the existing research content.
