摘 要
B2B电子商务作为电子商务中最具有潜力、占据市场份额最大的一种类型,对其研究有利于透视整个电子商务。对B2B电子商务反垄断法律问题的研究有利于解决B2B交易实践中发生的具体问题,更有利于促进我国反垄断立法的发展。虽然B2B交易市场由于其独特的特点,使其在具体的操作中出现了一些新问题,但是该特征并未使B2B交易市场上的垄断问题脱离了反垄断法的基本框架,因此,本文将在研究反垄断法的基本框架内研究B2B交易市场上的垄断问题,在现有的反垄断法基础上研究如何使其更能够适应新兴的B2B交易市场。
本文包含三个部分。第一部分为“电子商务简介及其中的反垄断因素的分析”,包括两个方面:首先,理清了电子商务的定义和类型,以明确以B2B交易市场作为本文研究视角的原因;其次,对电子商务市场上的反垄断因素展开分析,构建了本文研究的立论基础。第二部分,作者结合国外电子商务反垄断实例重点探讨了B2B交易市场上的垄断行为及法律规制,该部分是全文的重点。第三部分为作者以B2B交易市场为核心,提出了构建和完善我国电子商务市场反垄断规制的建议。

The anti-monopoly of e-commerce era -- the perspective about B2B trading market
Abstract
B2B e-commerce ,the most potential of e-commerce occupies the largest market share of a type, the research about the question of the anti-monopoly regulation could results the special drawbacks in the practice develop the anti-monopoly legislation of china. because of the special characteris of the B2B trading market,there are some new questions about the specific operation. However the unique characters did not make the features of B2B transactions on the market monopoly from the basic framework of the anti-monopoly law, therefore, we will research the monopoly on B2B trading market in the basic framework of the anti-monopoly regulations and research how to make it more adapt to the emerging B2B trading market.
This thesis composed three parts. The first part is “the electronic commerce synopsis and the analysis of the counter-monopoly factor,including two aspects: First, it has cleared off the electronic commerce definition and the type,,cleard by the reason why chose the B2B trading market as the perspect; Next, launches the analysis to the electronic commerce market's counter-monopoly factor, has constructed the argument foundation which this article studies. The second part, the author discuss the behavior and the regulations by unifing the overseas anti-monopoly example,this part is very emphasis in all article.The third part , the author take the B2B trading market as a core, proposed the plan to construct our country anti-monopoly rules and regulations of e-commerce market.
